Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Nula marketplace platform at nula.me (the "Platform"), operated by Kamal Agbaria ("we", "us", "our"). By accessing or using the Platform, you ("User", "you", "your") agree to be bound by these Terms.
Nula is a marketplace platform that connects consumers with independent service providers (businesses). We provide the technology that enables you to discover, browse, and book appointments with businesses listed on our Platform.
2. Eligibility
You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
3. Account Registration
Some features of the Platform require you to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information.
- Maintain and promptly update your account information.
- Keep your login credentials confidential.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
4. Marketplace Services — Disclaimer of Responsibility
Nula is a marketplace platform only. We do not provide, perform, or guarantee any of the services offered by businesses listed on the Platform.
Each business on the Platform is an independent service provider. Nula is not responsible for and makes no warranties regarding:
- The quality, safety, or legality of services offered by businesses.
- The accuracy of business listings, descriptions, prices, or availability.
- The qualifications, licenses, or certifications of service providers.
- Any interactions, agreements, or disputes between you and a service provider.
- Any injury, damage, or loss arising from services provided by businesses.
Any contract for services is formed directly between you and the service provider. You acknowledge that Nula acts solely as an intermediary and is not a party to any transaction between you and a business.
5. Bookings and Appointments
When you book an appointment through the Platform, you are requesting a service from an independent business. Please note:
- Booking confirmations are subject to the availability and acceptance of the service provider.
- Cancellation and rescheduling policies are determined by each individual business. Review their policies before booking.
- You are responsible for arriving on time and fulfilling any requirements set by the service provider.
- Nula may send booking confirmations and reminders on behalf of businesses, but the responsibility for service delivery lies solely with the service provider.
6. Payments
When payment processing is available on the Platform, payments for services booked through the Platform are processed securely by our payment processor, AllPay (allpay.co.il). By making a payment, you agree to AllPay's terms and conditions for payment processing.
Nula does not store your full payment card details. All payment information is handled securely by AllPay in compliance with applicable payment card industry standards.
Prices displayed on the Platform are set by the individual businesses. Nula does not control pricing and is not responsible for pricing errors or changes made by businesses.
7. User Conduct
You agree not to:
- Use the Platform for any unlawful or fraudulent purpose.
- Submit false, misleading, or defamatory reviews or content.
- Interfere with or disrupt the Platform or its infrastructure.
- Attempt to access accounts, systems, or data not intended for you.
- Use automated systems (bots, scrapers) to access the Platform without our written consent.
- Harass, threaten, or abuse other users or service providers.
- Upload or transmit malicious code, spam, or harmful content.
8. Reviews and Content
You may submit reviews, ratings, and other content through the Platform. By submitting content, you:
- Grant us a non-exclusive, royalty-free license to display, reproduce, and distribute your content on the Platform.
- Represent that your content is accurate, not misleading, and does not violate any third-party rights.
- Acknowledge that we may remove content that violates these Terms or applicable law.
9. Intellectual Property
All content, features, functionality, trademarks, and technology of the Nula Platform are owned by Nula and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Nula and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or from any services provided by businesses listed on the Platform, including but not limited to loss of profits, data, or goodwill.
Our total aggregate liability for any claim arising from your use of the Platform shall not exceed the total fees you have paid to Nula (if any) in the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Nula, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
13. Termination
We may suspend or terminate your access to the Platform at any time if you materially breach these Terms or engage in fraudulent or harmful activity. You may delete your account at any time through your account settings. Upon termination, your right to use the Platform ceases immediately.
14. Dispute Resolution
14.1 Complaints
We aim to acknowledge all complaints within 2 business days and resolve them within 10 business days. If we cannot resolve your complaint within this timeframe, we will inform you of the expected resolution date.
14.2 Governing Law
These Terms are governed by the laws of the State of Israel. Any dispute arising from these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts in Israel.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or through a notice on the Platform at least 14 days before taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
